MARIE FOLEY READING – Visual Library TERMS OF USAGE

Please read these Terms of Usage ("Terms") carefully before using the Visual Library. By subscribing to and accessing the Visual Library, you agree to be bound by these Terms.
1. INTELLECTUAL PROPERTY OWNERSHIP
All materials, including but not limited to videos, images, and posters (the "Content"), are the exclusive intellectual property of Marie Foley Reading. This Content is protected by international copyright, trademark, and other proprietary laws. Your subscription grants you a license to use the Content, not ownership of the Content itself.
2. Grant of License
Subject to your payment of subscription fees, Marie Foley Reading grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Content for personal, educational, and non-commercial purposes only.
3. Permitted and Prohibited Uses
Permitted Use: You may view the Content and download or print materials solely for your own personal, non-commercial educational use.
Commercial Restriction: No part of the Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without express prior written permission from Marie Foley Reading. Purchase does not transfer copyright and reproduction or resale is prohibited.
Prohibited Conduct: You shall not: Remove, alter, or obscure any copyright, trademark, or other proprietary notices. Sharing login credentials or providing access to the Visual Library to any third party is a violation ofthe subscription terms.
4. Account Security
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Marie Foley Reading immediately of any unauthorized use of your account.
5. Termination of Access
Violation of these Terms will result in the immediate termination of your subscription and access to the Visual Library at the sole discretion of Marie Foley Reading, without refund.
6. Disclaimer of Warranties
The Content is provided on an "as is" and "as available" basis without any warranties of any kind. Marie Foley Reading does not guarantee that the Content will always be available or error-free.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada.
8. Cancellation and Refund Policy
Automatic Renewal: Your monthly or annual subscription will automatically renew at the end of each billing cycleunless you cancel your membership through your account settings or by contacting Marie Foley Reading directly. Cancellation Process: You may cancel your subscription at any time. To avoid being charged for the next billing cycle, you must cancel at least 24 hours before your renewal date. Access After Cancellation: Upon cancellation, you will continue to have access to the Visual Library content until the end of your current paid billing period. Following the expiration of that period, your license to use the content—including any downloaded materials—will terminate. No Refunds: All subscription fees are non-refundable. Marie Foley Reading does not provide refunds or credits for any partial subscription periods or unused content.
9. Personal Information
When you subscribe and purchase a membership on this website, we collect personal information from you to enable your member sites access. We may collect information like your:
Billing and shipping address
Details relating to your subscription
Email address
Name
Phone number
We provide this information to Squarespace, our website hosting provider, so that they can provide exclusive member site hosting services to us and help us manage our relationship with you. As you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience.
10. Invoice Information
We use branded invoices to collect payments. We share this information with Squarespace, our website hosting provider, so they can provide invoicing services to us. We may collect information like your:
Email address
Invoice details (for example, line items)
Name
Payment history
Squarespace makes use of Stripe, a third-party payment processing provider which also receives your personal information and processes it in accordance with their privacy policies.
11. Cookies

12. Marketing Emails
We may send you marketing emails, which you can unsubscribe from by clicking the link at the bottom of the email. We provide your contact information to Squarespace, our email marketing provider, so they can send these emails on our behalf and help us manage our relationship with you.

If you create a customer account on this website, we collect personal information to improve our checkout experience and customer service. This information may include your:

14. Squarspace and Stripe Payments
When you make a purchase from us on this website, we use Squarespace Payments as our payment solution.Squarespace Payments is a fully integrated, native payment solution provided to us by our online store service provider Squarespace. Squarespace Payments makes use of the following third party service providers which will also receive your personal information and process it in accordance with their privacy policies:

16. Indemnification
You agree to indemnify and hold harmless Marie Foley Reading, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) that such parties may incur as a result of or arising from:
Your Use of the Content: Any use of the Visual Library materials that violates these Terms;
Violation of Intellectual Property: Your infringement of any copyright, trademark, or proprietary right belonging to Marie Foley Reading or any third party;
Account Misuse: Any activity related to your account, whether by you or any other person accessing the Visual Library using your login credentials.
17. Limitations of Liability
To the maximum extent permitted by applicable law, in no event shall Marie Foley Reading, its affiliates, or its licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of orrelating to the use of, or inability to use, the Visual Library. Under no circumstances will Marie Foley Reading be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of your account or the information contained therein. To the maximum extent permitted by the laws of the Province of Ontario, the total liability of Marie Foley Reading for any claims under these Terms, including for any implied warranties, is limited to the total amount you paid to Marie Foley Reading for the subscription period in which the claim arose.
18. Right to Modify Terms
Marie Foley Reading reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this site and updating the February 2026 terms.
